Birchmore’s Police Supervisor Approved WHAT Interview?!
When investigators interviewed Matthew Farwell about Sandra Birchmore's death, they did it in a school parking lot without taking notes or making a recording. Trooper Matthew Dunne testified that Sgt. John Fanning, his supervisor, made those tactical decisions. The aim, Dunne explained, was to prevent Farwell from ending the conversation and asking for an attorney. So what was gained by the approach, and what was lost?
Tony Brueski and Bob Motta examine the judgment call that sat above the initial investigation. Dunne later told jurors that Farwell had been untruthful about his relationship with Birchmore. The trooper acknowledged that he had not questioned Farwell's coworkers at the Stoughton Police Department. Prosecutors argue that such gaps matter because Farwell, a former officer, was seen at Birchmore's apartment building before her death. The defense maintains she took her own life. Farwell denies the federal charges accusing him of killing her and her unborn child.
Former prosecutor Eric Faddis brings another set of questions: how should a department handle surveillance footage and reports concerning one of its own officers? Stoughton police officials testified about learning of video from Birchmore's building. State Police examiner Nicholas Guarino testified that he did not locate messages in the search he conducted on Farwell's phone, which investigators subsequently returned. Federal examiners later identified thousands of communications from Birchmore's devices.
The differences between those investigative steps are tangible. A recording preserves an account. A phone extraction has a defined scope. Witness interviews can confirm or challenge what an officer says. The live discussion asks which shortcomings can be explained as mistakes and which require further examination before anyone can call them deliberate protection.
